Terms of Service

Please read these terms carefully before using MelaninWell.

Notice: This is a general terms document provided as a starting point. It should be reviewed by a licensed attorney before you rely on it for legal protection.

1. What MelaninWell Is

MelaninWell is a directory and matching platform that connects subscribers with independent health, legal, financial, and spiritual professionals. MelaninWell does not itself provide medical, legal, financial, or spiritual advice, treatment, representation, or services of any kind. We are not a party to any relationship, agreement, or engagement formed between a subscriber and a professional listed on the platform. Any advice, care, or service you receive comes solely from the professional you engage.

2. Eligibility

You must be at least 18 years old to create an account or use the Services. By creating an account you represent that you are 18 or older and legally able to enter into this agreement.

3. Account Responsibilities

  • Provide accurate, current, and complete information when registering and keep it up to date.
  • Maintain one account per person. Sharing or transferring accounts is not permitted.
  • Keep your password confidential and take reasonable steps to secure your account. You are responsible for all activity that occurs under your account.
  • Notify us promptly if you suspect unauthorized access or a security breach.

4. Professional Listings

Professionals listed in the directory are independent third parties, not employees, agents, or partners of MelaninWell. We review submitted credentials as part of onboarding, but we do not guarantee the accuracy of third-party information, the outcome of any engagement, or the quality of care, advice, or services provided by any listed professional. To the fullest extent permitted by law, MelaninWell disclaims all liability arising from the acts, omissions, advice, treatment, or services of any listed professional.

5. User Content

You are responsible for any articles, events, reviews, or other content you submit. You agree that your submissions will be accurate, will not infringe the intellectual property or privacy rights of any third party, and will not violate any law or our community guidelines. MelaninWell may review, edit, decline, or remove any content that we determine, in our sole discretion, violates these terms or is otherwise inappropriate.

6. Payments

Access to certain features is currently free. Some features may require payment in the future. If we introduce paid features, we will update these Terms and provide notice of the applicable pricing and billing terms before you are charged.

7. Termination

MelaninWell may suspend or terminate your account at any time, with or without notice, if we believe you have violated these Terms, engaged in fraudulent or harmful activity, or if required by law. You may close your account at any time by contacting us.

8. Disclaimers and Limitation of Liability

The Services are provided "as is" and "as available," without warranties of any kind, express or implied, including any warranty of merchantability, fitness for a particular purpose, or non-infringement. To the maximum extent permitted by law, MelaninWell, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or in connection with your use of the Services. Our total aggregate liability for any claim relating to the Services shall not exceed one hundred U.S. dollars (USD $100) or the amount you paid us in the twelve months preceding the claim, whichever is greater.

9. Governing Law

These Terms are governed by the laws of the State of Ohio, without regard to its conflict of law rules. You agree to the exclusive jurisdiction of the state and federal courts located in Ohio for any dispute that is not otherwise subject to arbitration or informal resolution.

10. Changes to These Terms

We may update these Terms from time to time. When we do, we will post the revised version here with an updated effective date. Material changes may also be communicated by email or a prominent notice on the platform. Your continued use of the Services after the revised Terms take effect constitutes acceptance of the changes.
